Conditions of Sale
By ordering goods from Kshocolât Ltd, the customer accepts these conditions of sale regardless of any previous agreements, unless confirmed in writing by Kshocolât Ltd.

Payment
We must receive full payment of the price for the products that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide at the point of order. Acceptance of your order brings into existence a legally binding contract between us.

Packaging
Due to our constant product development, the packaging on items you receive may differ from those pictured on the website.

Prices
The price of the goods is that specified on the website, current at time of placing your order.

All prices quoted are inclusive of V.A.T.

Delivery
Delivery will be made to the address provided by the customer at the point of order.
Delivery charges are as per set out on our website.

Kshocolât Products and Nuts
All of our products may contain traces of nuts due to the manufacturing processes used.

Cancellation of Order
We reserve the right to cancel the contract between us if:

We have insufficient stock to deliver the products you have ordered. If this is the case, we
will contact you to advise of an availability date or to offer you a substitute product.

We do not deliver to your area; or one or more of the products you ordered was listed at an incorrect price due to a typographical error.

If we do cancel your contract we will notify you by e-mail and will re-credit to your
account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order.

Your Rights of Cancellation
You may cancel your order before it is despatched by emailing orders@kshocolat.com.

Alternatively, you can cancel up to 7 working days (starting the day after you receive your goods) by emailing orders@kshocolat.com

The cost of returning goods that are not faulty shall be payable by you (the customer). A traceable delivery service is recommended as Kshcocolat cannot be held liable for goods lost in transit. A refund will typically be issued within 7 days of receipt of the returned goods.

The time taken for the amount to credit your payment method may vary depending on the financial institution. If in any event you have not received the credit within 30 days then please email orders@kshocolat.com and we will endeavour to help.

Liability
If the products we deliver are not what you ordered or are damaged or defective or the
delivery is of an incorrect quantity, or if you do not receive the products ordered, we
shall have no liability to you other than as set out below.

If you notify a problem to us under this clause, our only obligation will be:

to make good any shortage or non-delivery;

to supply and deliver substitute products if your original choice cannot be delivered for
any reason;

to replace any products that are damaged or defective; or

to refund to you the amount paid by you for the products in question in whatever way we
choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential
loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the products in question in whatever way we choose.

Kshocolât, any other party (whether or not involved in creating, producing, maintaining or
delivering this website), and the officers, directors, employees, shareholders or agents of
any of them, exclude all liability and responsibility for any amount or kind of loss or
damage that may result to you or a third party (including without limitation, any direct,
indirect, punitive or consequential loss or damages, or any loss of income, profits,
goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with this website in any way or in connection with the use, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this website or your downloading of any material from this website or any websites linked to this website.

You must observe and comply with all applicable regulations and legislation, including
obtaining all necessary customs, import or other permits to purchase products from our site.
The importation or exportation of certain products to you may be prohibited by certain
national laws. We make no representation and accept no liability in respect of the export or import of the products you purchase.

Notwithstanding the foregoing, nothing in these Terms and Conditions is intended to limit
any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Privacy Policy

Kshocolât use the latest in Secure Server Technology to ensure that all personal and transactional information is protected to the highest standards.

Data Protection

Kshocolât is a registered data user under the Data Protection Act. We never make your personal details available to other companies for marketing purposes other than for the marketing of Kshocolât branded products and services. We (and our representatives) may hold your personal details in order to process your order and/or maintain your account and/or for research purposes.
